A document by which one person authorises another to act on their behalf. An ordinary power is an agency: it lets the holder act while the principal has capacity, but it terminates automatically on the principal’s death or loss of legal capacity, which is the exact moment continuity is most needed.
Under UAE civil law an agency ends on the loss of the principal’s capacity, carried into the recodified Civil Transactions Law (Federal Decree-Law No. 25 of 2025, in force from 1 June 2026), and the UAE recognises no lasting or enduring power, so an ordinary power is at its most useless when an English lasting power is at its most useful.
A definition of an established legal or tax concept for general information. It is not advice on any individual situation.
